These General Terms and Conditions (GTC) apply to all contracts concluded with Wachauer Hotel- und Betriebs GmbH (Contractor), provided they fulfil the characteristics of the GTC Act. They may be replaced by terms negotiated in individual cases. These GTC shall be brought to the attention of or handed over to each guest or client upon conclusion of corresponding agreements.
The guest accommodation contract is concluded as soon as the rooms have been ordered and confirmed or, if no longer possible due to time constraints, made available.
If rooms or other services (e.g. events) are reserved on an option basis, the option dates are binding for both contracting parties. After expiry of the agreed option period, Wachauer Hotel- und Betriebs GmbH may freely dispose of the rooms, services or dates booked on an option basis without consultation.
Agreed prices may be changed by Wachauer Hotel- und Betriebs GmbH after conclusion of the contract in accordance with the then valid price lists if the period between conclusion of the contract and provision of the individual services is more than 4 months.
Unless other terms of payment (e.g. bank transfer) have been expressly agreed, invoices are due for payment immediately on receipt of the invoice, without any deductions and in cash or by ec card. In the event of late payment, Wachauer Hotel- und Betriebs GmbH is entitled to charge interest at a rate of 5 percentage points above the base rate.
Wachauer Hotel- und Betriebs GmbH is entitled to demand any order acceptance, reservation or other services from a guest as a total or partial amount in advance without justification.
In cases of cancellation of reservations for events or rooms by the guest or non-utilisation of the services offered (e.g. buffet offers, catering offers, room offers), the contractual services ordered and reserved but not accepted by the guest will be charged to the guest by Wachauer Hotel- und Betriebs GmbH at the following flat rates:
The cancellation fees shall be reduced by the amounts that are generated by the subletting of the cancelled rooms or further charging of the services on the ordered or reserved date on the part of Wachauer Hotel- und Betriebs GmbH. The above cancellation fees shall also apply if the ordered and reserved services are only partially cancelled by the guest, in which case the aforementioned flat rates shall relate to the part of the services that was cancelled, or if the guest does not make use of the ordered or reserved services without express cancellation.
Any cancellation must be made in writing by post, fax or email.
Each reservation becomes effective and guaranteed only by means of an offer signed in writing by the client of Wachauer Hotel- und Betriebs GmbH. For events, this must be submitted with a legal signature at least 8 calendar days before the start of the event. Booked premises shall only be available to the contractual partner at the agreed times. Any use beyond this requires the prior agreement and consent of Wachauer Hotel- und Betriebs GmbH.
The attachment of decorative material or other objects is not permitted without the express consent of Wachauer Hotel- und Betriebs GmbH. The client shall be liable without proof of fault for any damage to the furnishings or inventory caused during assembly and dismantling and/or during the event.
As a rule, guests are not permitted to bring their own food to events held at the hotel. In special cases, a separate agreement can be made with Wachauer Hotel- und Betriebs GmbH.
However, you can bring your own drinks to the events. In this case, however, a service fee of €0.35 per glass used will be charged. The Wachauer Hotel- und Betriebs GmbH reserves the right to change prices in accordance with point 3 of these General Terms and Conditions. Wachauer Hotel- und Betriebs GmbH accepts no liability or warranty for the food and drinks you bring yourself.
The guest does not acquire any claim to the provision of specific rooms.
Reserved rooms are available to the guest from 2.00 pm. These must be vacated by 10.30 a.m. at the latest on the day of departure. If these rooms are not vacated in time, Wachauer Hotel- und Betriebs GmbH reserves the right to charge for further accommodation.
Reserved rooms must be occupied by 6 pm on the day of arrival at the latest. Unless a later arrival time has been expressly agreed, the hotel may dispose of the rooms thereafter.
From 01.01.2023 a fee of € 2.00 will be charged per night and per vehicle.
a) The hotel is liable for the due diligence of a prudent businessman. However, this liability is limited in the area of non-typical services to deficiencies in performance, damages, consequential damages or disruptions that are attributable to intent or gross negligence on the part of the hotel. In the event of disruptions or deficiencies in the hotel's performance, the hotel shall endeavour to remedy such upon knowledge thereof or upon immediate complaint by the customer. The customer is obligated to contribute what is reasonable to him/her in order to remedy the disruption and to keep any possible damage to a minimum.
b) The hotel shall be liable to the customer for items brought into the hotel in accordance with the statutory provisions, i.e. up to one hundred times the room rate, up to a maximum of EUR 3,000, and for money and valuables up to EUR 1,000. Money and valuables may be stored in the hotel or room safe up to a maximum value of EUR (sum insured). The hotel recommends making use of this measure. Liability claims expire unless the customer notifies the hotel immediately after becoming aware of the loss, destruction or damage (§ 703 BGB).
c) The legal provisions apply to the unlimited liability of the hotel.
d) Insofar as a hotel parking space is made available to the customer, even for a fee, this shall not constitute a custody agreement. The hotel shall not be liable for loss of or damage to motor vehicles parked or manoeuvred on the hotel's property and their contents, except in cases of intent or gross negligence. This also applies to vicarious agents of the hotel.
e) Wake-up calls are carried out by the hotel with the utmost care. Claims for damages, except for gross negligence or intent, are excluded.
f) Messages, mail and consignments of goods for guests are handled with care. The hotel shall undertake the delivery, safekeeping and - on request - forwarding of the same against payment. Claims for damages, except for gross negligence or intent, are excluded.
